Can Your Fitbit Be Used For or Against You In Your Personal Injury Claim?

fitbit.jpgFitness trackers are the new craze. You can walk into any gym and see that the majority of people have some type of device tracking their heart rate, the steps walked or calories burned. A Fitbit has recently made headlines here in Florida . Nina Risley, from St. Petersburg, traveled to Pennsylvania and was staying at her boss' home when police say she called to report she was raped by an unknown intruder. According to the police report, officers obtained her Fitbit Surge device and "the Fitbit device showed that Nina was awake and walking around the entire night prior to the incident and did not go to bed as reported" Police believe the steps recorded on her device prove Nina was awake and staging the crime scene instead of being asleep and ripped out of bed like she claimed. She was later charged with making a false report and tampering with evidence.

I-10 Claims Lives On Memorial Day

As a personal injury attorney, I am regularly faced with my client's devastating injuries and damages caused by motor vehicle accidents. One of my greatest fears is that I will become numb, calloused, or unemotional to the plight or unfortunate situations faced by my clients. That question was answered for me on Memorial Day. I was traveling westbound on I-10 with my family returning home from a weekend trip to central Florida. My wife told me that she had not seen any vehicles on I-10 eastbound lanes for several minutes. I began to notice the lack of vehicles on the road too. I quickly assumed that there had been an accident. Several minutes later we approached an accident scene that appeared on its face as a serious crash. We quickly realized that the accident involved several vehicles and that at least two adults had lost their lives in the accident. Later, we discovered that two people were found dead at the scene with two critically injured. According to WKRG Channel 7, the accident occurred in Jackson County, Florida.

Personal Injury: Kraft Recalling Products

Parents, avoid personal injury to your minor child.  WEAR Channel 3 reports Kraft Foods Group is voluntarily recalling 242,000 cases of its Kraft Macaroni & Cheese Dinner because some boxes may contain small pieces of metal. According to the news release, the company reports affected boxes were stamped with 'Best if used by' dates of September 18 through October 11, 2015, with the code 'C2' directly below the date on each box.

CAR SEATS AND BOOSTERS REQUIRED IN FLORIDA

Beginning January 1 (Thursday), children ages 4 and 5 are required to sit in a child safety seat or a booster seat rather than only being buckled in a seat belt. According to the CDC, booster seat use reduces the risk for serious injury by 45 percent for children ages 4-8 years when compared with seat belt use alone. Child-safety advocates struggled for years to achieve this tightening of the law, which has been one of the weakest nationwide. Until state lawmakers approved the tougher requirement, Florida and South Dakota were the only states that didn't require booster seats for children after they turned 3.

RUBBER MULCH: SAFE OR HARMFUL?

When I first moved to the area, I thought it was a great idea instead of sand or a hard packed surface then I started to wonder if it was really as beneficial as I thought it was when I thought about how hot it gets here and whether or not some of the chemicals could literally rub into my children as they played in it....
