What Is Florida's Statute Of Limitations On Sexual Abuse?

In the event of sexual abuse, the law imposes serious and significant punishment. Florida law also provides the victim of sexual abuse with the rights to bring a civil action against the perpetrator and, if applicable, his or her employer. Florid law will, in most cases, hold the employer of the perpetrator vicariously liable for the wrongs of its employee. Vicarious liability is a form of a strict, secondary liability that arises under the common law doctrine of agency, also referred to as "respondeat superior". Simply put, the employer is responsible for the acts of its subordinates. It is also well recognized in Florida that a daycare, preschool, or school owes your child a fiduciary duty. A fiduciary duty is a legal duty to act solely in another person's interests.

Understanding Child Abuse Claims

Florida Jury Instructions tell us that if a parent places a child in the care and custody of another, such as a day care, and that custodian was negligent in caring for and/or supervising the child there could be a credible cause of action against the day care worker and his/her employer. It is the parent or guardian's burden to establish that the day care's negligence was a legal cause of the child's injury and/or death. One might assume that the day care's negligent conduct or omissions (failure to act) caused the loss, injury or damage, but it takes a trained professional (attorney/lawyer) to establish evidence that 'connects the dots'.
