Trucking safety regulations and personal injury litigation

An accident that occurred earlier this month on the other side of the state is a reminder of the damage large commercial vehicles can cause when involved in a crash.

The crash involved a city dump truck that ploughed into the back of a taxi and thereby started a chain reaction involving multiple other vehicles. The taxi driver tragically died and seven others required treatment at a local hospital.

The Miami Herald report did not indicate a suspected cause for the serious accident. It was mentioned, though, that witnesses did not hear the sound of brakes prior to the crash. Did the dump truck's braking system fail, or was the trucker asleep or incapacitated at the wheel? Such details often don't emerge until a thorough investigation is conducted.

Who was at fault?

If you have been in an accident involving a commercial vehicle, establishing liability is an important task which requires attention to the details surrounding the crash. In some cases, it is possible to point to violations of federal and state safety regulations to demonstrate that the driver, and/or his or her employer, acted negligently.

There are a number of rules and regulations which commercial operators are required to obey. These requirements touch on things like vehicle safety and maintenance, size and weight restrictions, proper securement of cargo, hours of service compliance, and other matters. Commercial vehicle operators who fail to obey these rules can be held accountable in personal injury litigation.

Clearly identifying and demonstrating a driver's negligence is not always an easy matter. For this reason, it is critical to work with an experienced personal injury attorney to ensure you receive adequate compensation to get back on with your life.
