Did you know that over 90% of all new cars have event data recorders installed? We have all known about this technology and how it is used in investigating accidents involving commercial trucks and airplanes. Investigators have used this data for decades to determine the cause of an accident. But, did you know that your modern car is also tracking and recording vital information following an accident. It has been reported that these data recorders or Black Boxes only record information once air bags are deployed, so I 'guess' we are to feel comforted that we are not be watched and tracked by 'Big Brother' except when we are involved in an accident.

According to new National Highway Traffic Safety Administration ("NHTSA") rules, every vehicle manufactured after September 1, 2014 must be equipped with a Black Box. Does this bother you? It is definitely concerning to me, but not for the reason that you might expect. Yes, law enforcement will use the information to make a determination as to who was criminally at fault for a crash. Yes, the information will also be compiled by NHTSA in an attempt to improve the safety of our roads. However, what about the person injured in an accident? How will insurance companies attempt to use or dispose of the information when someone has been injured in an accident? Based on my experience, if this information is not properly interpreted or misused by insurance companies, my clients (including you) may be on the receiving end of an unjust settlement or result at trial. Also, confusion can be caused by false-positive reports. If data is not interpreted by a trained professional, the incorrect impression can be obtained resulting in adverse consequences to injured accident victims.
